Life imprisonment was required. The Court assessed a nominal MPI of 15 years based on the brutality, duty breach, deceit and harm, but also the offender's youth, COVID-19 isolation, disadvantaged upbringing and neurological immaturity. Because those factors made a presumptive 17-year MPI manifestly unjust relative to the 15-year nominal MPI, the court imposed life imprisonment with a minimum period of imprisonment of 15 years.

Because the defendant was the sole instigator who deliberately planned arson and cynically used a vulnerable person as an innocent agent, her culpability was high; having regard to comparable authorities the appropriate starting point was nine years six months, reduced by four months for co-operation via VMR and by a modest additional discount for limited criminal history, youth and prospects of rehabilitation, producing a sentence of eight years three months for manslaughter and a concurrent five year sentence for arson, effective eight years three months' imprisonment.

The High Court held the end sentence of three years' imprisonment was not manifestly excessive because a starting point of four years was justified by premeditation, home invasion, extreme victim vulnerability and repeated violence; after lawful discounts the overall sentence was proportionate to the offender's culpability.

The Court held the four year starting point for aggravated robbery was within range given aggravating features (weapon use causing a cut, forced entry, threats to family and property, vulnerability of victim and element of home invasion); the 12 month uplift for demanding with menaces was appropriate because it involved separate offending and separate victims; the aggregate sentence of five years and six months was not manifestly excessive, and the appeal against sentence was dismissed.

The end sentence of two years and six months' imprisonment was not manifestly excessive. A 3.5 year starting point for gross indecent assault involving oral contact on a vulnerable IHC resident and significant breach of trust was within the available range; the sentencing Judge did not make an error that vitiated the sentencing discretion and discounts of 10% for character/remorse and 20% for guilty pleas were appropriate.
