Where a building is an eligible WHRS Act property and owners have made a qualifying s32 application, s37 WHRS Act suspends limitation for an eligible WHRS claim in High Court proceedings such that defendants sued for both weathertightness and other defects may be sued in the same proceeding even if the s393 Building Act ten-year longstop has passed; therefore the strike-out applications of the council and engineer were dismissed.
