On the balance of probabilities the medical evidence established the appellant's knee did not incapacitate him for Police duties at the time of disengagement; his decision to leave was driven primarily by non-injury factors, so he did not meet the statutory incapacity threshold and was not entitled to weekly compensation or vocational rehabilitation under ss37 and 22 of the Act.
