The court accepted and approved the parties' settlement under s 61B of the Charitable Trusts Act 1957: the executors must pay $1,000,000 to the plaintiff and counterclaimants by 31 October 2018; in return the plaintiff and counterclaimants disclaim any further interest, discontinue proceedings and release the estate/executors/trustees; the Attorney-General approves the compromise for charitable beneficiaries; and the clause 9 trust is to be formalised without provision for Muriel Gwendoline Turner or the deceased's nieces and nephews.
