The memorandum of wishes, when read with the prior 2006 will and the deed of trust and supported by evidence of signing and the deceased's statements, on the balance of probabilities expressed the deceased's testamentary intentions and therefore had the appearance of a will and should be declared valid under s 14 Wills Act 2007.
