The court was satisfied under s 31(1) of the Wills Act 2007 that clause 3(c) contained a clerical error and that replacing "wife" with "husband" was necessary to give effect to the deceased's testamentary intention; the application to correct the will was therefore granted.

The codicil contained a clerical error that produced an uncertainty inconsistent with the testatrix's clearly expressed intention; therefore, under s 31 of the Wills Act 2007 the court must correct the codicil by inserting the qualifying words so the will gives effect to the testatrix's intention, and the application may be dealt with without notice because it affects only the applicants.

The court held that the references in both codicils to the will dated 23 February 2007 were clerical errors and that s 31 Wills Act 2007 authorized correcting those dates to 24 April 2007 because the testamentary scheme and surrounding evidence clearly demonstrated the testator intended the codicils to refer to the 24 April 2007 will and not to revive the earlier will.
