Because the appellant failed to establish a physical injury as required by s29 of the Accident Insurance Act 1998, her long-term benzodiazepine dependency and withdrawal symptoms do not constitute a compensable "personal injury" and therefore the medical misadventure claim fails; consequently it was unnecessary to decide whether informed consent was obtained.
