The Court exercised its discretionary power under s14 to validate both informal codicils because each plainly expressed the deceaseds' testamentary intentions despite failing s11 formalities, and validation was appropriate given the parties' negotiated Deed of Settlement and supporting evidence; an order disapplying s13(1) for the deceased's codicil was also appropriate.
