Leave to appeal was granted because the legal question whether a claimant's description of their injury can determine the legal character of the claim (and thus which statutory timetable, s56 or s57, applies) is a question of law capable of serious and bona fide argument and merits determination by this Court.

On the balance of probabilities the appellant's high level of occupational exposure to plaster dust contributed to the development of her COPD (s30(2)(b)), and the court found that the risk was significantly greater for workers in that environment than for others (s30(2)(c)); smoking did not negate the workplace contribution given cessation in 1999 and worsening from 2001, therefore entitlement to cover under s30 established.

The disease arose from a single acute exposure in 1969 and is not a work-related gradual process; therefore the injury occurred before 1 April 1974 and is excluded from accident compensation cover, so the appeal is dismissed.
