The Court found the 28 month imprisonment manifestly excessive in all the circumstances including the offender's youth, time already spent in custody and prospects for rehabilitation, and accordingly quashed the custodial sentences and substituted a total of nine months' home detention with specified breakdown and conditions.

The Court fixed a starting point of 2 years 10 months imprisonment given the defendant's lesser role relative to the ringleader, applied a 20% guilty plea reduction and a further reduction approaching 25% for youth, remorse, lack of prior convictions and strong rehabilitative prospects, producing an adjusted sentence just over 18 months; because that adjusted sentence was under 24 months and home detention was proportionate and conducive to rehabilitation, the Court imposed nine months' home detention concurrent on both charges.
