Leave to commence by originating application was granted under r 19.5 and the Court, satisfied that the owner is deceased, that due inquiries have been made and no agent or administrator in New Zealand has been identified, and that appointment is advisable to protect the interests of potential claimants and to secure development or better utilisation of the land, appointed Public Trust as manager under ss 99 and 100 of the Public Trust Act 2001.
