The appellant failed to prove on the balance of probabilities that the failure to diagnose in 2002 materially and substantially caused premature end-stage renal failure in 2004; medical evidence was inconclusive and the evidence establishes the end-stage failure was wholly or substantially caused by the underlying condition, which excludes cover under s32(2)(a).
