The Court was not satisfied on the affidavit material that Briscoes acted for an improper ulterior motive or that the claim was hopeless given unresolved factual disputes and an acknowledged serious issue to be tried; accordingly indemnity costs were refused and 2B costs were awarded to StorageOne as recorded in its 29 January 2016 memorandum of support.
