The High Court dismissed the judicial review: Auckland Council's decision to impose the APTR was not unreasonable, the Council adequately considered the mandatory s101(3) factors and 'stood back' from its allocation decision, and its consultation processes met the s82 principles; refinements made (geographic differentiation, remissions, later inclusion of informal providers) were lawful responses to consultation and not grounds for invalidation.
