LAWYERS FOR CLIMATE ACTION NZ INCORPORATED v THE CLIMATE CHANGE COMMISSION [2022] NZHC 3064

- Court
- High Court
The Commission's Advice was reviewable; however the Court found no legal error: the Commission did not commit a demonstrable logical/mathematical error, correctly interpreted and applied the Act's dual purposes (meeting the 2050 Target and contributing to the global 1.5°C effort) and mandatory considerations, was empowered to advise on accounting rules, could lawfully recommend the MAB methodology given New Zealand's circumstances, and its Advice was not irrational or unreasonable. The judicial review application was dismissed.
