The Court concluded there were sufficient grounds to allow the appeal on charges 13 and 14 and entered judgments of acquittal on those charges; it found no reversible error in respect of the remaining convictions and upheld the refusal to grant a discharge without conviction; the sentence was varied to six months' home detention and otherwise the post-detention conditions were retained.

The Supreme Court granted leave in part limited to the question whether the Court of Appeal was correct to follow R v Degnan and hold that propensity evidence may be led by the Crown despite having been led at a trial resulting in an acquittal; the Court refused leave on the other grounds because they did not meet the statutory criteria for grant of leave.

Section 144A contemplates appeals only from determinations on questions of law that are material to a judgment adverse to the proposed appellant; where the High Court result was successful for the applicant (a discharge deemed an acquittal under s106), there is no right of further appeal to the Supreme Court, and leave is refused.
