OTL, as copyright owner, has suffered a loss in the form of the lost opportunity to cause OGL to earn profits; that lost opportunity is quantifiable as the $4.1 million loss suffered by OGL and is recoverable by OTL; accordingly judgment for OTL for $4.1m against the defendants.
