Barber failed to demonstrate any arguable defence to the Council's liquidation claim; the unpaid statutory demand constituted prima facie evidence of inability to pay and justified proceeding; therefore the application for extension of time to defend was refused and the liquidation application was adjourned to permit payment by 26 March 2015 rather than immediate liquidation.
