Although the prosecutor's cross-examination was inappropriate, the conduct did not render the trial overall unfair nor breach the appellant's right to silence; the other evidentiary and direction issues involved application of established principles to trial facts and were not of sufficient general or public importance nor cumulatively sufficient to show a miscarriage of justice, so leave to appeal is refused.
