Because the liquidation application was publicly advertised in breach of a court order, creating prejudicial pressure on the defendant and the plaintiff's solicitors were aware or should have been aware and failed to alert the court or defendant promptly, the proper exercise of the court's jurisdiction required striking out the liquidation proceedings; costs to lie where they fall.
