The application for leave to adduce further affidavit evidence was refused because the proposed affidavits were non‑compliant with affidavit formalities, not fresh, not cogent and unlikely to be material to the issues on appeal; some proposed evidence was hearsay or inadmissible opinion and admission would cause delay and additional costs.
