Applying summary judgment principles the Court accepted BBC's reconciliation of payments and invoices for the identified transactions, found Topagri's asserted additional liabilities and counterclaim were either arguable only to the extent quantified and/or lacked evidential foundation, allowed deductions for arguable items (discounts, customs/freight, specific costs and parts) and entered summary judgment for the plaintiff for the remaining indisputable balance of US$144,001.10, with costs to the plaintiff.
