Plaintiff failed to prove on the balance of probabilities that defendants owed or withheld top-up payments or that Mr Cho was a de facto director or knowingly dishonest; evidence of the alleged top-ups was inadequate and the transfers were made by Mr Cho as a narrowly authorised signatory acting on instructions without actual knowledge or wilful blindness; accordingly all causes of action failed and claim dismissed.
