The court held that alleged drug and alcohol use during the relevant employment period were material to the causation inquiry under s7(1)(b) and that the existing expert assessments were potentially unreliable without a full history; accordingly the appeal could not be finally determined and the proper course was to direct sworn evidence from the appellant on substance use, refer that evidence to Dr Monigatti and the PCP Panel for reassessment, and adjourn for final hearing.
