Because the originating application comprised bald allegations of incompetence without particulars and no supporting evidence, it amounted to an abuse of process under r5.35B; the appropriate remedy was to stay the proceeding and require a notice of proceeding and a statement of claim with full particulars in accordance with Part 5 before any further steps, and to refuse the request for deputy registrar personal information outside statutory channels.
