LIC did not owe fiduciary duties of loyalty to the farmer appellants or to competing semen sellers; the representations about the AES were not misleading or deceptive when read in context by the informed farming audience (dollar figures were predictive opinions, reliability percentages related to the animal model and were not misleading, and trialling/audit statements were correct); accordingly the appeal is dismissed.
