The Court found a serious question to be tried because the spreadsheet contained information with the necessary quality of confidence, it was imparted in circumstances importing an obligation of confidence (inadvertently and/or unauthorisedly transmitted), and there was a real risk of unauthorised use; applying the balance of convenience and overall justice the Court continued interim injunctions and directed disclosure and preservation steps to protect EQC's position pending a substantive hearing.
