Mr B failed to comply with a direction to file company accounts and did not explain the omission, causing unnecessary preparation by Mrs B's counsel; that conduct justified a 10% increase on the 2B costs scale. However, Mr B's reliance on authority and his response to the Calderbank offer did not by themselves justify increased costs. A deduction was warranted for the first case management conference appearance; remaining calculation of costs is to be carried out by counsel or submitted by memorandum.
