Rule 20.16 governs admission of further evidence on appeal; s61(4) does not displace it. Special reasons were not established for most of the additional material; limited further evidence was admitted (full Cryonics Institute website for context; certain Timeship project materials; the DVD if it contained material that could have made a difference; and certain Official Information Act material subject to resolution). Applications for oral evidence and to cross-examine the Department analyst were refused. The Court directed service on the Attorney-General. No costs awarded.
