The appellate court concluded the trial Judge's factual findings were open on the evidence: the appellant must have been aware of the struggle and seen the stolen bag, and by driving the offender away she assisted him with the requisite knowledge and intention to enable avoidance of arrest/conviction; there was no miscarriage of justice and the sentence of 80 hours' community work and nine months' supervision was within the permissible range and not manifestly excessive.
