The High Court dismissed the appeal and remitted the proceeding to the District Court for determination of any rehearing and for the appellant to advance a s94 application because the appellant was effectively seeking a fresh first‑instance application and the appropriate procedure is remittal under the Criminal Procedure Act 2011.
