The court found on the balance of probabilities that Dr Collier's assessment complied with the statutory assessment regime and AMA Guides, that he had appropriate training and reviewed relevant material, and that the differences between Dr Collier and Dr Newburn were differences of degree and emphasis rather than material errors; therefore the appellant failed to establish the assessment was flawed and the appeal was dismissed.
