The appellants' application to adduce fresh evidence largely failed: category A and D evidence refused, category B largely refused except limited admission of the PowerPoint for procedural irregularity, and category C admitted; given the respondents' substantially greater success the appellants are denied costs and the respondents are awarded costs, but at a reduced scale (category 1A) to reflect the limited nature of their success.
