Leave to appeal was refused because the Supreme Court does not have jurisdiction to entertain an appeal from the Court of Appeal's refusal of leave under s 213(3) of the Criminal Procedure Act 2011, and even accepting a leapfrog route, the conviction relating to Y was based on the applicant's external conduct (request to lift her top) so the later decision in Rowe did not vitiate the reasoning of the courts below.
