The appeal could not be dealt with on the papers because the Tribunal's decision involved findings of fact and section 126 of the Human Rights Act 1993 mandates that two additional lay members from the panel maintained under s101 be appointed for such appeals; accordingly the High Court declined to proceed on the papers and directed the Registrar to arrange appointments and a conference.
