Costs were awarded to the respondents: $9,003.24 for the 1 March 2023 decision because that sum represented actual costs and was below the calculated 2B scale; $3,585 for the 12 July 2023 decision on a 2A basis with specified time allowances; respondents are also to be paid disbursements as set out in their memoranda.

Special leave was declined because the High Court's refusal was not plainly wrong, the arbitrator was highly qualified (a retired judge) chosen by the parties, the dispute was a commercial matter of limited public importance and likely limited substantial effect, and an as-of-right appeal on natural justice grounds remained available.

Leave to appeal was declined because the Court found no error of law: the umpire gave a reasoned independent and substantive valuation within the statutory bounds, the lease clause excluding improvements was properly interpreted as excluding direct value of improvements (and no established neighbourhood uplift was shown), and the tribunal acted within its broad evidential discretion in admitting and using the rating valuation exhibit.
