Extension of time was granted because the striking out of the initial appeal arose from procedural circumstances not attributable to the appellants, the delay was not excessive and was explained, there was no real prejudice to the respondent, and the proposed appeal was not hopeless on its face such that an indulgence should be refused; further, r 20.13(6) meant security for costs should not have been fixed while the legal aid application remained undetermined.
