CLARKE v NEW ZEALAND POLICE [2017] NZCA 198
- Citation
- [2017] NZCA 198
- Court
- Court of Appeal
Leave to bring a second appeal was declined because the grounds relied on were challenges to factual and credibility findings made by the trial Judge and upheld by the High Court, did not raise matters of general or public importance, and there was no risk of miscarriage of justice; BORA warnings were found to have been properly given and self-defence did not apply to the failing to remain charge given the factual finding that the direction to remain was heard and the arrest was lawful.
