The Supreme Court dismissed the application for leave to appeal, holding that the trial judge did not err in discharging the foreperson and continuing the trial with 11 jurors because he was best-placed to assess the risk of prejudice, gave appropriate directions, and there was no appearance of a miscarriage of justice or public importance warranting a mistrial.
