The High Court (Keane J) held that a review under s 26P can be ancillary to a continuing proceeding such that security for costs may be ordered under r 5.45, but set aside the Associate Judge's order because he failed properly to take account of the applicant's substantial recent receipt of $270,000 when exercising his discretion to require security, and therefore the security order was unjustified and must be vacated.
