On balance the court ordered consolidation: the proceedings overlap sufficiently in subject matter and parties that consolidating will reduce judicial resources and not materially elongate trial or cause undue prejudice; any risk of inconsistency can be managed by scheduling and will be outweighed by efficiency gains, so consolidation under r 10.12 is justified.
