Chen was in contempt of the 4 April 2007 Mareva order because he failed to take reasonable steps to prevent registration of transfers to his nominee (mother-in-law), procured subsequent sale and application of proceeds, authorised or permitted application of Top International sale proceeds to Heard Park Ltd, and failed to disclose bank accounts required by the order; security for costs was refused because the counterclaim operates as a set-off/defence and ordering security would be inappropriate.
