- High Court
The application for early discharge was refused because the applicant failed to discharge the evidential onus of showing good cause: he had a prior bankruptcy, a criminal conviction leading to company management disqualification, no present prospect of paying creditors, and had only served about five months of the bankruptcy period; the court fixed an 18‑month restriction under s298(1)(e) so he may not reapply before 2 April 2015 and declined to impose a condition deferring any future discharge until payment of the judgment creditors' costs.
