The Court concluded Luxor has a seriously arguable case (including arguable estoppel and legitimate use of subcontractors known pre-contract) and that the balance of convenience favors maintaining operation of the machines pending resolution because Luxor would suffer disproportionate commercial harm while The Warehouse can be compensated by damages; accordingly an interim injunction to reconnect and continue operation was granted subject to protective conditions and an undertaking as to damages.
