The court implied a term that the exclusive licence, being a commercial contract of indeterminate duration involving mutual trust and ongoing obligations, was terminable by either party on reasonable notice; applying the relevant commercial factors and the existing clause 10.1(b) the court held three months' notice was reasonable, therefore Mevon validly terminated the licence and the licence expired on 8 December 2016 subject to clauses 10.4, 10.5 and 10.6.
