After repeated adjournments and clear direction that the appellants must obtain either a hearing date for the appeal or an application for leave to extend time by the specified date, the appellants failed to do so and have no viable causes of action owing to the Official Assignee's refusal to continue or assign them; accordingly the proceeding CIV-2011-419-1047 must be struck out as an appropriate exercise of the Court's power to prevent abuse and to protect fairness to the opposing parties.
