The defendants were entitled to some costs because they succeeded on the central legal issue of witness immunity which disposed of two of three causes of action; however the plaintiff retained one cause so overall success was comparable and justifies awarding the defendants 50 percent of costs on a 2B basis for both the review and the initial strike-out application, and quashing the Associate Judge's costs award.
