The court held that an offence of attempted infanticide exists: s178 defines the substantive offence of infanticide and s72 provides for attempts to substantive offences; reading those provisions together permits attempted infanticide despite s178's drafting focusing on death; accordingly the Crown's amendment from attempted murder to attempted infanticide was appropriate and granted under s133(1) Criminal Procedure Act 2011.
