    R v FAIGAN (SENTENCING NOTES) [2019] NZHC 3329

    Citation
    [2019] NZHC 3329
    Court
    High Court

Starting point of 48 months' imprisonment for attempted poisoning was appropriate given vulnerability of sleeping victims and high premeditation; reductions applied for victim conduct (10%), health (15%) and previous good character (15%) reduced the starting point to 31 months, a 25% guilty plea discount reduced it to 23.5 months, 1.5 months' credit for EM bail reduced it to 22 months, which was converted to 11 months' home detention given first offender status, serious health concerns and compliant EM bail.
