On the facts the Court found overwhelming evidence that Dr B provides care at least equivalent to registered nurse care, ACC applied its policy inflexibly and ignored relevant realities, and the Court may substitute a decision under the Act; therefore ACC must fund services provided by Dr B at the registered nurse rate from 29 October 2009 within the allocated 168 hours/week.
